Terms of Service

These terms are the agreement between you and JinFrame (204-401, Cheongwoo Goldbil, 19-11 Tanbeol-gil, Gwangju-si, Gyeonggi-do, Republic of Korea), who runs CaptionPopper ("we", "us"). By using CaptionPopper you agree to them. If you do not agree, please do not use the service. You must be at least 16 years old to use it.

1. What the service is

CaptionPopper turns the speech in a video into captions, lets you edit and style them, and exports the video with the captions on it. Your video is opened and exported in your own browser. Only the audio is sent to a speech recognition provider, and caption text is sent to an AI provider when you use translation or AI Magic. There is a free plan and paid plans. The plans, their limits and their prices are shown on the pricing screen, and they can change as described below.

2. Your account

You can try CaptionPopper without an account, within lower limits. To use more, or to buy a plan, you sign in with Google. Keep your account secure and do not share it. You are responsible for what happens under your account.

3. Plans, payment and cancellation

  • Paid plans are sold by Polar, our Merchant of Record. Polar is the seller: it collects payment and applicable taxes, and its Buyer Terms apply to your purchase in addition to these terms. Your plan rights come from us.
  • Paid plans renew automatically each month until you cancel. You can cancel at any time from Manage subscription, and you keep access until the end of the period you paid for.
  • If we change a price, we tell you by email at least 30 days in advance, and it applies from your next renewal after that. You can cancel before then.
  • Refunds are governed by our Refund Policy.

4. Your content

Your videos, captions, translations and projects belong to you. We do not claim ownership of them, and you do not have to credit us. Exports made on the free plan carry the "Made with CaptionPopper" watermark, and you may not remove it other than by upgrading.

You give us the limited permission we need to run the service: to process the audio you choose to transcribe, and the caption text you choose to translate or analyze, using the providers described in our Privacy Policy. You promise that you have the right to use the videos you process, and that doing so does not break anyone's rights or the law.

Your video stays on your device. Work that you do not export or save is lost when you close or refresh the page, so export or save what matters to you.

The service itself, including its software, design, templates and name, belongs to us or our licensors. You get the right to use it as these terms allow, but you may not copy it, reverse engineer it, or resell access to it. Captions and videos you make with it are yours.

5. Acceptable use

You agree not to:

  • process content that is illegal, or that you have no right to use;
  • use the service to create content that sexually exploits children, harasses or threatens people, or is meant to deceive or defraud;
  • get around plan limits, usage limits or the watermark, or use scripts and bots to use the service;
  • resell the service, or its output as a competing captioning service;
  • attack, probe or overload the service, or try to reach other people's data;
  • use the service in a way that breaks the terms of our providers or the law.

6. Automatic captions can be wrong

Speech recognition, translation and AI features make mistakes, especially with names, accents, background noise and technical words. You are responsible for reading and correcting captions before you publish them. We do not promise that captions are accurate or complete, or that they meet any accessibility, broadcast or legal requirement that applies to you.

The speaker detection feature only separates the voices inside one recording so they can be labeled "Speaker 1", "Speaker 2" and so on. We do not use it to identify who someone is.

7. Third-party services

CaptionPopper relies on other companies for hosting, sign-in, payments, speech recognition and AI. If one of them is down or changes, the service can be affected. We are not responsible for their services.

8. Changes to the service

We may improve, change or remove features, limits and plans. If a change significantly affects what you paid for, we will give you reasonable notice, and you may cancel. We do not promise the service will always be available or free of errors.

9. Suspension and ending

You can stop using CaptionPopper at any time, and ask us to delete your account. We may suspend or end your access if you break these terms or the law, or if your use puts the service or other people at risk. If we end a paid plan without a fault of yours, we will refund the unused part of the period you paid for.

10. No warranty

To the extent the law allows, CaptionPopper is provided "as is" and "as available", without promises of any kind, including that it fits a particular purpose or is free of errors. Rights you have by law as a consumer are not affected.

11. Limit of our liability

To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. If you only use the free plan, that amount is zero.

Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, intentional misconduct, gross negligence, or death or personal injury.

12. If someone makes a claim because of your content

To the extent the law allows, if a third party makes a claim against us because of content you processed or because you broke these terms, you agree to cover the reasonable costs and damages that result from it.

13. Copyright concerns

We do not publish or host your videos. If you believe content processed with CaptionPopper infringes your rights, write to support@captionpopper.com with what and where, and we will look into it.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Korea. If you have a problem, please write to us first at support@captionpopper.com and give us 30 days to work it out with you. If we cannot, the courts of the Seoul Central District Court have jurisdiction. If you are a consumer, this does not take away the consumer protection rights you have where you live, including the right to bring a claim in your local courts where the law gives you that right.

15. Changes to these terms

We may update these terms. When a change significantly affects you, we will notify you before it takes effect, for example on the site or by email, at least 30 days in advance. If you keep using CaptionPopper after that, you accept the updated terms. You can stop using the service and cancel your plan if you do not agree.

16. General

  • If we do not enforce a part of these terms right away, that does not mean we give it up.
  • If a part of these terms is found to be unenforceable, the rest stays in effect.
  • You may not transfer your account or your rights under these terms to anyone else.
  • These terms, together with the Privacy Policy and Refund Policy, are the whole agreement between you and us about the service.
